C. All maintenance, repairs and liabilities associated with the pedestrian <br />overcrossing shall be the responsibility of the applicant, its heirs, successors <br />and assigns. Prior to permit issuance for the pedestrian overcrossing, the <br />applicant shall provide the City with an agreement running with the land in a <br />form suitable for recording approved by the City Attorney's office whereby the <br />applicant, its heirs, successors and assigns hereby agrees to waive any right to <br />assert any claim related to any injury, loss or damage to people or property <br />including death arising out of or related to the pedestrian overcrossing including <br />but not limited to its design, maintenance, repairs and/or construction and <br />agrees to indemnify (including reasonable attorney's fees) and hold the City, its <br />officers, employees and agents harmless from any claim(s) related to any injury, <br />lo.;s or damage to people or property including death arising out of or related to <br />the pedestrian overcrossing including but not limited to its design, maintenance, <br />repairs and/or construction; provided, nothing herein shall require the applicant, <br />its heirs, successors or assigns to indemnify and hold harmless the City, its <br />officers, agents and employees from claims caused solely by the negligence of <br />the City, its officer, employees and agents, and provided further, [hat if the <br />claims are caused by or result from the concurrent negligence of (1) the <br />applicant, its heirs, successors and assigns, and (2) the City, its officers, agents <br />and employees, the indemnity provisions provided herein shall he valid and <br />enforceable only to the extent provided by law. <br />f. The applicant must review preliminary pedestrian overcrossing design concepts <br />with Public Works for their approval prior to final design. <br />3. Transit routes/schedules and high occupancy vehicle information must be prominently <br />displayed for employees at on -site commute information centers and near associated <br />walkways. Preferential parking space locations for carpools and vanpools must be <br />provided on all sites. Buildings must incorporate bicycle and pedestrian amenities <br />such as lockers, shower rooms, and bicycle stands. (SEPA Transportation and Land <br />and Shoreline Use Policies) <br />Section 3: EARTH/GEOLOGICALLY HAZARDOUS AREAS <br />4. Prior to issuance of grading permits for removing earth from a site, the applicant must <br />demonstrate that permits have been obtained for placement of the earth off -site. <br />( 2PA Earth and Water Policies) <br />5. Temporary slopes within native glacial soils shall be limited to a maximum angle of 1/2 <br />trot horizontal (11) to 1 foot vertical M. Temporary slopes within fill soils shall he <br />limited to a maximum angle of III: IV. Temporary slopes must be covered with an <br />impermeable membrane, such as visqueen or mulch, in order to prevent precipitation <br />from coming in contact with the soils.
