.,- AGREEMENT THIS AGREEMENT by and between .he City of Everett, a municipal corporation (hereinafter referred to as "City"), and 821 Associates (hereinafter also referred to as "heveloper"), is entered into this 13th day of ::ay . 19 80. WHEREAS, land io the vicinity of Casino Road between Airport Road and Evergreen Way is sought to be developed in multiple family and single famill residential uses as well as commercial uses; and 1t'HEREAS, it is desirable for the City of Everett to encourage the production of housing stock within the City while addressing the additional usage placed upon public improvements thereby; and WHEREAS, the planning and engineering staffs of City have determined that traffic generation from such multiple family and single family uses as well as commercial uses will adversely impact in a significant manner the vehicular and pedestrian traffic flow and movement nipon and adjacent to Casino Road between Airport Road and Evergreen Way; and WHEREAS, it is the opinion of :;ie Responsible Official of the. City under Its State Environmental policy Act kSEPA) ordinance that such significant adverse impact on the vehicular and pedestrian traffic flow and movement upon and adjacent to Casino Road between Airport Road and Evergreen Way may be mitigated H building, grading and/or other permits for development in the vicinity of Casino Road between Airport Road and Evergreen Way are conditioned to address and mitigate the impacts identified to be generated by the development in such vicinity of Casino Road; and WHEREAS, Developer desires to proceed with his development project in advance of the City Council comprehensively addressing development along Casino Road avid the needed public improvements required thereby, but Developer understands and is willing to presently commit to the policy decisions and specific requirements which the City Cotuicil deems necessary and appropriate ;,s a result of its comprehensive review;
