7. The specific amount of Developer's non-refundable cash payment for <br />street improvements calculated pursuant to Exhibit A is N/A <br />dollars ($ N/A ); or in the <br />alternative the specific amount of Developer's payment guarantee calculated <br />pursuant to Exhibit A is Eighty-seven Thousand Lighty Hundred Sixty-eight and 80/100s <br />dollars ($87,868.80--); provided, further, that the City Council may provide for <br />alternative methods or means instead of a cash payment to guarantee street <br />improvements. <br />8. Developer covenants' and agrees to save and hold City harmless from <br />any and all cost, expense, claim, cause of action or damage incurred by, suffered or <br />occasioned to developer, its successors in interest, tenants, .or lessees resulting <br />from, arising out of or proximately caused by the procedure agreed to .herein <br />including but not limited to costs, expenses, claims, causes of action or damage <br />from delay necessitated by additional environmental review or other challenge to <br />the procedures followed by the City pursuant to this Agreement and/or the final <br />ordinance whcci: the City Council adopts concerning development and public <br />improvements in the vicinity of Casino Road. <br />9. This Agreement covers only that project or phase of project for which <br />building permits are sought at this time.
