Davis and Associates, a <br />�Y�' f.�t�l,�//�1,�Qf ///�/�`i��1 Ei���l�S' i i't��,�;�,�/ii�i��t�ll/•// <br />Limited Partnership., (hereinafter "Davis" . <br />RECITALS <br />6c i� <br />WHEREAS, A erson is the fee owner of the real property <br />described in Exhibit A which is attached hereto and incorporated <br />herein by this reference (hereinafter "Parcel A"), and <br />WHEREAS, 821 Associates is the fee owner of the real <br />property described in Exhibit B which is attached hereto and <br />incorporated herein by this reference (hereinafter "Parcel <br />H"), and <br />WHERE)„ said parcels of real property are contiguous <br />to each other as shown on Exhibit C which is attached hereto <br />and incorporated herein by this reference, and <br />WHEREAS, 821 Associates proposes to develop apartment <br />n A �ik2' <br />or condominium units on Parcel B, and Anderson -plans to <br />develop apartment or condominium units on Parcel A at some <br />time in the future, and <br />WHEREAS, 821 Associates will construct a road through <br />Parcel B to provide access to Parcel A from Hardeson Road, <br />and 821 Associate:, will dedicate said access road to the <br />City of Everett for use as a putlic street, and <br />WHEREAS, surface water from Parcel B presently drains <br />across Parcel A, and ll <br />WHEREAS, until Parcel A is developed by Ard r on-, its+ <br />successors or assigns, surface water collecting on certain <br />portions of the access road through Parcel B, as shown on <br />Exhibit D which is attached hereto and incorporated herein <br />by this reference, may drain onto Parcel A, and <br />-1- <br />
