1. Respondents Sandra Saala and David Thorns are the owners of record of 1132 901" <br />SW, Unit #6, Everett, Washington (the "Propery") (Exhibit # 5, Snohomish County <br />Assessor's Property Information) <br />2. On August 6, 2010, the Everett Code Enforcement Unit received a complaint about <br />several instances of potentially illegal construction work being done on the <br />condominium building at 1132 901" SW. The property is developed with a <br />condominium structure. The property has a 6 unit condominium built on it. <br />(Testimony, Code Officer Fagerstrom) <br />3. On August 9, 2010, Code Officer Kevin Fagerstrom and Tony Lee and Ted Budden <br />from the City's Building Services Department, conducted an inspection at the <br />property and they observed and photographed a wall section and new staircase that <br />had been built in the upper floor of the southwest corner of the building. Unit 6 had <br />an enclosed space that had been added; and a lean to had been added on site; and <br />Unit 6 storage area (see exhibit 8). All of these items require building and other <br />permits. They were able to confirm that this area is a portion of Unit # 6 of the <br />condominium complex. The wall section was designed different from the rest of the <br />building and was clearly added after the original structure was completed. The <br />staircase was new. A later check of the Building Departments' records revealed that <br />no permit has been issued for either construction activity. (Exhibit #1, Inspection <br />photos dated August 9, 2010) (Testimony, Code OfficerFagerstrom, Ted Budden) <br />4. On September 1, 2010, a violation citation was Issued to the Respondents for a <br />violation of International Residential Code 105.1. A copy was mailed to the <br />Respondents via first class and certified US mail and a copy was posted at the <br />Property. (Exhibit #3, Violation Citation dated September 1, 2010) (Exhibit # 4, <br />Declaration of Service with photo) (Testimony of Code Officer Fagerstrom) <br />Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br />following Conclusions: <br />CONCLUSIONS OF LAW <br />Jurisdiction: <br />The Violations Hearing Examiner of the City of Everett has jurisdictional authority to <br />hold a hearing and to Issue the decision. That authority is set forth in EMC §1.20.020. <br />Jurisdictional authority of this matter shall continue for two years from the date of entry <br />of this order, or until specifically terminated by further order of the Violations Hearings <br />Examiner EMC 1.20.040 F.10. <br />Applicable Law: <br />International Residential Code 2006105.1, Permits required which <br />reads; <br />
