C Any owner or authorized agent who Intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, Install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installadon of which Is regulated by f is code, or cause any such work to be done, shall first make application to the building official and obtain the required permit. Conclusions of Law Based on Above Findings: By constructing a wall section including the installation of windows and a staircase, without permits, the Respondent has violated International Residential Code 106.1. ORDER Based on the Findings of Fact and Conclusions of Law as stated above, the following Order is issued: 1. The Respondents shall apply for and obtain all of the necessary and required permits to install wall sections that are part of condominium #6, and a staircase, and garage improvements or they shall obtain a Demolition Permit and remove and properly dispose of all of the construction activity, that was installed within the structure, without permits. This must be completed by March 31, 2011. 2. The Respondents are fined $500.00 for these violations. Of the $500.00 fine, $400.00 will be suspended based upon the successful completion of Item 1 above. The remaining $100.00 balance of the fine is payable to the Everett City Clerk's Office, located at 2930 Wetmore Avenue, Suite #100, Everett, WA 98201, no later than October 22, 2010. If at any time during the effective period of this Order, a violation is found of any of the listed Applicable Laws set forth in this Order, the remaining balance of the fine shall become due immediately. 4. If payment is not made on or before October 22, 2010, collection action will be taken, which may include assigning the debt to a collection agency pursuant to RCW 1.16.500. 5. The Respondents shall not violate any ordinance set forth in EMC 1.20.020 or any ordinance or regulation that identifies the enforcement procedure described in Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, for the next twenty-four (24) months. If the Property of found to be in violation during this time period, the suspended portion of the fine will be due Immediately. 6, This written Order shall be controlling over any conflicts with oral Orders issued at the Public Hearing.
