C <br />Any owner or authorized agent who Intends to construct, enlarge, alter, repair, <br />move, demolish or change the occupancy of a building or structure, or to erect, <br />Install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br />mechanical or plumbing system, the installadon of which Is regulated by f is <br />code, or cause any such work to be done, shall first make application to the <br />building official and obtain the required permit. <br />Conclusions of Law Based on Above Findings: <br />By constructing a wall section including the installation of windows and a staircase, <br />without permits, the Respondent has violated International Residential <br />Code 106.1. <br />ORDER <br />Based on the Findings of Fact and Conclusions of Law as stated above, the following <br />Order is issued: <br />1. The Respondents shall apply for and obtain all of the necessary and required <br />permits to install wall sections that are part of condominium #6, and a staircase, and <br />garage improvements or they shall obtain a Demolition Permit and remove and <br />properly dispose of all of the construction activity, that was installed within the <br />structure, without permits. This must be completed by March 31, 2011. <br />2. The Respondents are fined $500.00 for these violations. Of the $500.00 fine, <br />$400.00 will be suspended based upon the successful completion of Item 1 above. <br />The remaining $100.00 balance of the fine is payable to the Everett City Clerk's <br />Office, located at 2930 Wetmore Avenue, Suite #100, Everett, WA 98201, no later <br />than October 22, 2010. If at any time during the effective period of this Order, a <br />violation is found of any of the listed Applicable Laws set forth in this Order, the <br />remaining balance of the fine shall become due immediately. <br />4. If payment is not made on or before October 22, 2010, collection action will be taken, <br />which may include assigning the debt to a collection agency pursuant to RCW <br />1.16.500. <br />5. The Respondents shall not violate any ordinance set forth in EMC 1.20.020 or any <br />ordinance or regulation that identifies the enforcement procedure described in <br />Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br />for the next twenty-four (24) months. If the Property of found to be in violation during <br />this time period, the suspended portion of the fine will be due Immediately. <br />6, This written Order shall be controlling over any conflicts with oral Orders issued at <br />the Public Hearing. <br />C64 <br />
