The State of Washington has adopted several RCWs addressing the issue of aviation <br />land use compatibility. RCW 36.70.547 and RCW 36.70A.510 requires cities and <br />counties to take proactive measures to protect public use airports from the <br />encroachment of incompatible land uses. The most common result of single family <br />residential development near airports is conflict and diminished quality of life for people <br />living near the airport. Citizens living under the direct flight path or within the <br />established traffic pattern are significantly impacted from aircraft noise, light, vibration <br />and fumes associated with normal airport operations. <br />WSDOT Aviation has reviewed the Draft Supplemental Environmental Impact <br />Statement (DSEIS), for the CEMEX Materials project and offers the following <br />observations and recommendations: <br />• Modern modes of transportation must grow to meet population demands. <br />Aviation is dynamic transportation mode with a growing demand for access to <br />commercial service. <br />• Capacity constraints will occur within the Puget Sound Region by 2030. <br />-Aviation Planning Council July, 2009 <br />• Snohomish County/ Paine Field is one of only four airports within Washington <br />State with airside and landside capacity for scheduled commercial service. <br />Aviation Planning Council July, 2009 <br />• The proposed project falls within the City of Everett's identified airport influence <br />area. <br />• The City of Everett has recognized Snohomish County/ Paine Field Airport as an <br />essential public facility, and has adopted policies to protect it from the <br />encroachment from incompatible land uses: These policies include: <br />o 2.11.8 (a) Protect the viability of the airport as an essential public facility <br />and a significant economic resource to the community by encouraging <br />compatible land uses and reducing hazards that may endanger aviation <br />users. <br />o 2.11.8 (g) Evaluate all proposed amendments to the comprehensive plan, <br />capital facilities plan and urban growth area that will increase incompatible <br />land uses or the potential of incompatible development adjacent to the <br />airport through inappropriate land use or zoning designations or <br />inadvertent land use policies. <br />Draft Supplemental Environment Impact Statement (DSEIS), for the CEMEX Materials project <br />October 25, 2009 <br />Page 2 of 4 <br />
