F. ISSUE - PEDESTRIAN ACCESS TO PROPOSED OFFICE <br /> Shockey Appeal <br /> The Shockey appeal objects to whether a sidewalk should be <br /> required between the proposed office and Everett Ave. <br /> Findings: While the proposed office on Everett Avenue is <br /> not expected to be used by the general public, Subsection <br /> 39 .165 of the Zoning Code nevertheless requires all <br /> commercial uses to "provide pedestrian connections to form <br /> logical routes from origins to destinations. " Employees <br /> will use the building and will need appropriate pedestrian <br /> connections. The office would have its primary exposure to <br /> Everett Avenue, which would be a logical point of origin. <br /> It follows that providing a sidewalk or pathway linking the <br /> office with Everett Avenue would be a logical pedestrian <br /> connection. <br /> Conclusions: The requirement for a pedestrian connection is <br /> a necessary improvement which will facilitate access to the <br /> proposed office structure. It is also a Zoning Code <br /> standard. <br /> Neighborhood Appeal - Pedestrian access was not an appealed <br /> issue. <br /> G. ISSUE - MDNS REQUIRES THAT LARGE CONTAINERS BE COVERED AND <br /> SEALED <br /> Shockey Appeal <br /> Condition #4 under, Mitigation by Existing Codes and <br /> Ordinances, requires that containers stored on the site be <br /> leak-free, with close-fitting covers. The Shockey appeal <br /> states that the containers which would be stored on the site <br /> do not have covers and are not leak-free because they open <br /> from the side. <br /> Findings: The MDNS states that that containers stored on <br /> the site must be "leak-free, with close fitting covers. " <br /> Item G of the Shockey appeal objects to this requirement on <br /> grounds that the existing containers do not have covers and <br /> cannot be sealed. The Applicant submitted that the <br /> containers cannot be modified to meet this requirement, and <br /> that use of covered containers would not be practical . <br /> The Department of Ecology commented that, additional <br /> stormwater pretreatment would be required if containers are <br /> not covered. <br /> The MDNS states that pretreatment of stormwater runoff from <br /> the site may be required. <br />
