Conclusion: The Applicant should have an option to cover <br /> the containers or to provide industrial pretreatment of <br /> stormwater runoff if containers are not covered. <br /> Neighborhood Appeal - The issue of providing covers for <br /> containers was not appealed. <br /> H. ISSUE - IMPROVEMENT AND MAINTENANCE OF ALLEYS ABUTTING THE <br /> SITE <br /> Shockey Appeal <br /> The Shockey appeal refers to Condition #8 under Information <br /> for Developer, of the MDNS. This condition states that <br /> performance guarantees are required for the alley <br /> improvements. <br /> Findings: Performance guarantees (i.e. , bonds) must be <br /> posted for all projects requiring public street or alley <br /> improvements. The purpose of the performance guarantee is <br /> to ensure that the improvements are constructed. Because <br /> alleys are City property, responsibility for future <br /> maintenance of the alleys abutting the site would lie with <br /> the City, not the Applicant. <br /> Conclusions: City staff believes the Applicant's concern <br /> about future alley maintenance has been satisfied. <br /> Neighborhood Appeal <br /> The Neighborhood appeal maintains that the MDNS does not <br /> require that alleys abutting the site be improved to a <br /> minimum standard in order to avoid damage by truck traffic. <br /> Findings: Condition #3 under, Information by the Developer, <br /> of the MDNS states, "The alley rights-of-way along the <br /> property's frontage must be paved per City standards. " The <br /> applicable City Standard (No. 303) requires three inches of <br /> Class B asphalt overlaid on a structural roadway base. " (See <br /> Exhibit #12. ) Alleys which are constructed to this standard <br /> can accommodate heavy truck traffic such as trucks operated <br /> by Rubatino. Prior to issuance of permits, the Applicant <br /> will be required to provide detailed engineering drawings <br /> which demonstrate that the alley will be constructed to the <br /> applicable standard. <br /> Conclusions: City Standard No. 303 for alley construction <br /> is a straightforward code requirement. This standard would <br /> be applied even if a SEPA review were not required for the <br /> proposal. Implementation of this standard will ensure that <br /> the alleys are not damaged by heavy truck traffic. <br />
