That the variance will not be materially detrimental to the <br /> property in the area of the subject property or to the City as a <br /> whole. <br /> C. That the variance will only grant the subject property the same <br /> general rights enjoyed by other property in the same area and zone <br /> as the subject property. <br /> D. That the variance is the minimum necessary to allow the subject <br /> property the general rights described in Criterion 3. <br /> E. The granting of the variance is not inconsistent with the goals <br /> and policies of the Everett General Plan. <br /> F. The need for the requested variance is not the result of a <br /> self-created hardship. <br /> 33. Pursuant to the SEPA and DNS, the proposal will be required to have five <br /> feet of landscaping surrounding the perimeter of the site. This <br /> landscaping and other vegetation in the area will satisfy the <br /> requirement that the utility facility be landscaped. <br /> 34. Because of the location of the subject property and its relatively <br /> higher elevation than other areas of the City, special circumstances <br /> exist for the granting of the variance. The location of the property <br /> and the placement of the pole on the property allows for the cellular <br /> service to be provided to the entire Everett area. <br /> 35. Because of the physical property, the cellular radio frequencies, and <br /> the need for exposure, it is not possible to locate the facility <br /> underground. <br /> 36. Engineering tests have been conducted which have determined that the <br /> minimum height requirement for the proposed tower is 126 feet. Any <br /> structure that is less than 126 feet will not function effectively. <br /> 37. The tower will be designed, constructed, and located in a manner that <br /> will have minimum visual impact on adjacent properties. Through the use <br /> of distancing, landscaping, and screening, the visual impacts will be <br /> mitigated. <br /> 38. Other above ground utilities have been permitted in the City. Because <br /> of the increase in need for cellular phone service, a variance is needed <br /> to allow the Applicant the same general rights enjoyed by other property <br /> owners in the same area and zone in which the property is located. <br /> 39. The requested variance is a minimum variance request. As previously <br /> noted, the cellular system must be constructed to a height of 126 feet <br /> in order to provide transmission to all of the Everett service area. <br />
