i1 <br />ORDINANCE NO. <br />An Ordinance Amending the Local Project Review Procedures for Review Process <br />II, amending Ordinance No. 2530-01, as amended (EMC Title 15). <br />WHEREAS, it is necessary to amend the City's land use code and procedural <br />requirements from time to time to address changing circumstances and emerging needs; <br />and <br />WHEREAS, the City Council adopted the Local Project Review Procedures Ordinance <br />No. 2530-01 to implement RCW Chapter 36.7013 to provide a master procedural <br />ordinance for land use applications within the City of Everett, including public notice <br />requirements for various types of land use applications; and <br />WHEREAS, the public notice requirements for Review Process II (Planning Director <br />review) include mailing to contiguous property owners; and <br />WHEREAS, there exists numerous property configurations in the City that could result in <br />insufficient public notice using the common definition of contiguous; and <br />WHEREAS, the City Council finds that the amendment is necessary to provide <br />clarification so property owners receive adequate notice for Review Process II <br />applications; and <br />WHEREAS, the City's Review Procedures regulations need to be revised to allow the <br />Planning Director to review use of basements and other areas within the B-3 zone using <br />the Process II Review; and <br />WHEREAS, the City Council finds that the proposed amendment promotes the best long <br />term interests of the Everett Community. <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1: Subsection 3(B) of Chapter 4 of Ordinance No. 2530-01, as amended (EMC <br />15.16.080), which reads as follows: <br />Decisions included. <br />20 <br />
