7 AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT <br /> THIS AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT(the <br /> "Amendment") made and entered into on this day of September,2010, by and between the <br /> City of Everett(the"City") and Washington State Umpires Association d/b/a United States <br /> Specialty Sports Association(the "Service Provider"). <br /> WHEREAS,the City and Service Provider entered into that certain Professional Services <br /> Agreement dated February 15, 2010, to provide umpires for the Everett Parks and Recreation <br /> Adult Softball League for the City of Everett(the "Agreement"); and <br /> WHEREAS, the 2010 softball team registrations exceeded projected budget registrations <br /> by nine percent (9%) and additional umpire services are needed; and <br /> WHEREAS, there is a need to increase the maximum compensation to Service Provider; <br /> NOW THEREFORE, the parties herein do mutually agree as follows: <br /> 1. Paragraph 4 subsection D of the Agreement is hereby deleted and replaced with the <br /> following: <br /> D Total compensation, including all services and expenses, shall not exceed <br /> a maximum of Sixty-Three Thousand Dollars ($63,000). <br /> 2. All terms, conditions and provisions of the Agreement remain in full force and effect <br /> except as expressly modified by this Amendment.
