N <br /> RESOLUTION 3550 <br /> CITY COUNCIL FINDINGS <br /> AND <br /> CONCLUSIONS <br /> RE: <br /> SEPA APPEAL OF <br /> THE COLBY <br /> A MIXED USE DEVELOPMENT: 64 APARTMENTS, 3,976 SQ FT OF RETAIL AND <br /> 32 PARKING SPACES <br /> SEPA # 61-91 <br /> INTRODUCTION <br /> 1. WHEREAS, the City Council finds that on June 19 , 1991 , the City <br /> received an application from David Mandley (LOJIS) for a SEPA <br /> environmental review for the construction of a Mixed Use <br /> development in downtown Everett. Sixty-four (64) dwelling units <br /> and 3 ,496 square feet of retail space are proposed. The Zoning <br /> Code requires .5 parking spaces per dwelling unit, so thirty-two <br /> (32) parking spaces are proposed on-site. Parking is to be <br /> located at ground level, below the apartments, with access from <br /> the alley. The retail space is one-story high, located in front <br /> of the parking area and has pedestrian access from Colby. The <br /> proposed project is located mid-block on the East side of Colby <br /> between 25th and 26th Streets, which is in the most northerly <br /> portion of B-3 , the Central Business District Zone. All zoning <br /> requirements were reflected in the original site plan submission <br /> which has not been changed. <br /> 2 . WHEREAS, the City Council finds that after review of an <br /> environmental checklist and public and agency comments, a <br /> Mitigated Determination of Non-Signficance (MDNS) (SEPA # 61-91) <br /> was issued September 10, 1991. The Revised MDNS included three <br /> new mitigation measures volunteered by the applicant: SEPA <br /> Mitigation Measures Five, Six, and Seven. These measures related <br /> to parking. <br /> 3 . WHEREAS, the City Council finds that the SEPA Ordinance <br /> (Ordinance 1348-87) Policies pertaining to the Built Environment <br /> are the basis for SEPA mitigation measures. The Ordinance <br /> includes the following statement: <br /> "B. Land and Shoreline Use <br /> i. Relationship to Land Use plans and estimated population: <br /> To implement and further the City's Comprehensive Plans, <br /> including the Land Use Plan, Transportation Plan, Open <br /> clbyffcr <br />
