ORDINANCE NO. <br /> An Ordinance Amending the Zoning Code Related to Secondhand Stores, <br /> Amending Ordinance No. 1671-89, as amended(EMC Title 19) <br /> WHEREAS, the City Council finds the following: <br /> 1. The City Council adopted the Downtown Plan in 2006, establishing a new vision for the <br /> future development of the City's central business district; and <br /> 2. The City Council adopted revised regulations for the for the B-3 zone concurrent with the <br /> adoption of the Downtown Plan in order to regulate future land.uses and development <br /> consistent with the vision stated in the downtown plan; and <br /> 3. The B-3 zone regulations include a designation for"retail streets" (Map No. 22-2) <br /> intended to concentrate quality retail uses and compatible activities in certain areas, and <br /> exclude certain uses that were felt to be incompatible or inconsistent with quality retail <br /> activities; and <br /> 4. The B-3 zone regulations include higher quality development standards for building <br /> facades and streetscape improvements on designated retail streets to reinforce the vision <br /> for a pedestrian friendly retail district; and <br /> 5. The Zoning Code prohibits certain uses on the ground floor of buildings fronting on retail <br /> streets, including "secondhand stores,"but does not define the term; and <br /> 6. Owners of property within the designated retail streets have asked the City to consider <br /> amending the prohibition on secondhand stores on designated retail streets in order to <br /> allow antique stores, antique malls and sale of certain used merchandise; and <br /> 7. The Planning Commission held public discussions about the proposed code amendments <br /> on July 14, 2009; April 20, 2010; May 18, 2010; June 15, 2010; and July 20, 2010; and <br /> recommends that the City Council amend the B-3 Zone regulations to allow antique <br /> stores, antique malls, and secondhand stores on a portion of the Hewitt Avenue frontage <br /> within the area designated"retail streets"by Map No. 22-2; and <br /> 8. Subsequent to the Planning Commission making its recommendation,the City received <br /> additional written and verbal testimony suggesting additional revisions to allow antique <br /> 2 <br />
