and secondhand retail sales on Wetmore and Rucker Avenue, and on a larger portion of <br /> Hewitt Avenue than had been recommended by the Planning Commission.; and <br /> 9. The proposed code amendments will also add definitions of several terms that are used in <br /> the proposed code amendment but not currently defined in the Zoning Code; and <br /> 10. The proposed amendments to the Zoning Code will allow for retail sales of certain used <br /> merchandise in a manner that is consistent with the intent of the B-3 zone and the <br /> regulations pertaining to retail streets to reinforce an active retail environment and <br /> pedestrian friendly streetscape. <br /> WHEREAS, the City Council concludes the following: <br /> 1. The proposed amendment to the Zoning Code is consistent with the Everett Downtown <br /> Plan, a subarea plan of the City of Everett Growth Management Comprehensive Plan; <br /> and <br /> 2. The proposed amendment to the Zoning Code bears a substantial relation to the public <br /> health, safety and welfare; and <br /> 3. The proposed amendment to the Zoning code promotes the best long-term interests of the <br /> Everett community. <br /> • <br /> NOW, THEREFORE, THE CITY OF EVERETT ORDAINS the following: <br /> Section 1. Special Regulation No. 66 of Table 5.2 of Ordinance No. 1671-89 as amended by <br /> Section 36 of Ordinance No. 2397-99, as amended by Section 2 of Ordinance No. 2923-06 <br /> (EMC 19.05), which reads as follows: <br /> (66) Parking lots are not permitted in areas designated as retail streets by Map 22-2,unless located <br /> • behind the building. The following uses, whether specifically listed or not in Table 5.2, shall be <br /> prohibited on the ground floor in areas designated as retail streets by Map 22-2: Food banks,tattoo <br /> parlors, blood or plasma donor centers, body piercing, churches, pawnshops, secondhand stores, <br /> places of assembly, teen clubs,private clubs, fraternal organizations, social service facilities. <br /> Be and the same is hereby amended to read as follows: <br /> (66) Parking lots are not permitted in areas designated as retail streets by Map 22-2, unless located <br /> behind the building. The following uses, whether specifically listed or not in Table 5.2, shall be <br /> prohibited on the ground floor in areas designated as retail streets by Map 22-2: Food banks,tattoo <br /> parlors, blood or plasma donor centers, body piercing, churches, pawnshops, secondhand stores, <br /> thrift stores, junk stores, places of assembly, teen clubs, private clubs, fraternal organizations, <br /> social service facilities; except that secondhand stores, antique stores and antique malls may be <br /> 3 <br />
