15 AMENDMENT ONE <br /> To <br /> MEMORANDUM OF UNDERSTANDING <br /> For <br /> PESTICIDE-FREE TRIAL PROGRAM at LOWELL PARK <br /> With <br /> THE LOWELL CIVIC ASSOCIATION <br /> This MEMORANDUM, entered into the day of December, 2010, constitutes <br /> Amendment No. 1 to the"Memorandum of Understanding"between the City of Everett, <br /> "the City" and The Lowell Civic Association herein after called"LCA,"entered into on <br /> the 4th day of December, 2009. <br /> WITNESSETH: <br /> WHEREAS, Section 7.0 of the Memorandum of Understanding provides for adjustment <br /> or modification of the Memorandum of Understanding by the City; and <br /> WHEREAS,the City and The LCA agree that the one year pesticide-free trial program at <br /> Lowell Park should be extended for one additional year to help insure that the trial <br /> program's evaluation is comprehensive and supported with a more complete set of data. <br /> NOW, THEREFORE,the CITY and The LCA mutually agree as follows: <br /> Section 12 of the Memorandum of Understanding is modified to change"this <br /> Memorandum and the trial program expire one (1) year after such date,unless sooner <br /> terminated"to "the Memorandum and the trial program shall expire on December 4, <br /> 2011, unless sooner terminated." <br /> All other terms and conditions of the Memorandum, as amended, shall remain in full <br /> force and effect. <br /> IN WITNESS WHEREOF, The LCA and the City have executed this Memorandum as of <br /> the day and year first above written. <br /> CITY OF EVERETT THE LOWELL CIVIC ASSOCIATION <br /> jiVAHH,Q.-By By _Ray Stephanson, Mayor Nar1 (.
