ORDINANCE NO. 2909-06 AN ORDINANCE ADOPTING REVISED ZONING CODE REGULATIONS FOR CRITICAL AREAS; PARTIALLY REPEALING SECTIONS 1 THROUGH 24 OF ORDINANCE NO. 1838-91, AS AMENDED (EMC 19.37); AMENDING THE ZONING CODE DEFINITIONS FOR CRITICAL AREAS, AMENDING ORDINANCE NO. 1847-92, AS AMENDED (EMC 19.4.020); AND AMENDING LOCAL PROJECT REVIEW PROCEDURES, ORDINANCE 2530-01, AS AMENDED (EMC 15.16.080.A) WHEREAS, the Washington State Growth Management Act (GMA) requires the City of Everett to designate critical areas and to adopt development regulations to protect critical areas (RCW 36.70A.060 and .170 and WAC 365-194-410); and WHEREAS, the City of Everett adopted an interim set of Zoning Code regulations for protection of environmentally sensitive areas which became effective in January, 1990, on an interim basis until the City's Comprehensive Plan Policies for critical areas could be reevaluated; and WHEREAS, following adoption of a comprehensive set of policies upon which to base its regulations for the protection of critical areas, the City of Everett adopted a revised set of Zoning Code regulations pertaining to critical areas in Ordinance No. 1838-91 that became effective in December 1991; and WHEREAS, RCW 36.70A.172, which became effective in 1995, requires that jurisdictions include best available science in developing policies and development regulations to protect the functions and values of critical areas and to give special consideration to conservation or protection measures necessary to preserve or enhance anadromous fisheries; and WHEREAS, the City's best available science review is contained in the following documents and is supported by a comprehensive number of sources as referenced in said documents: • July 1, 1991 memorandum from Katy Chaney, Dames & Moore to Allan Giffen.
