ORDINANCE NO. 2909-06 <br />AN ORDINANCE ADOPTING REVISED ZONING CODE REGULATIONS <br />FOR CRITICAL AREAS; PARTIALLY REPEALING SECTIONS 1 THROUGH 24 OF <br />ORDINANCE NO. 1838-91, AS AMENDED (EMC 19.37); <br />AMENDING THE ZONING CODE DEFINITIONS FOR CRITICAL AREAS, <br />AMENDING ORDINANCE NO. 1847-92, AS AMENDED (EMC 19.4.020); <br />AND AMENDING LOCAL PROJECT REVIEW PROCEDURES, <br />ORDINANCE 2530-01, AS AMENDED (EMC 15.16.080.A) <br />WHEREAS, the Washington State Growth Management Act (GMA) requires the City of Everett <br />to designate critical areas and to adopt development regulations to protect critical areas (RCW <br />36.70A.060 and .170 and WAC 365-194-410); and <br />WHEREAS, the City of Everett adopted an interim set of Zoning Code regulations for protection <br />of environmentally sensitive areas which became effective in January, 1990, on an interim basis <br />until the City's Comprehensive Plan Policies for critical areas could be reevaluated; and <br />WHEREAS, following adoption of a comprehensive set of policies upon which to base its <br />regulations for the protection of critical areas, the City of Everett adopted a revised set of Zoning <br />Code regulations pertaining to critical areas in Ordinance No. 1838-91 that became effective in <br />December 1991; and <br />WHEREAS, RCW 36.70A.172, which became effective in 1995, requires that jurisdictions <br />include best available science in developing policies and development regulations to protect the <br />functions and values of critical areas and to give special consideration to conservation or <br />protection measures necessary to preserve or enhance anadromous fisheries; and <br />WHEREAS, the City's best available science review is contained in the following documents <br />and is supported by a comprehensive number of sources as referenced in said documents: <br />• July 1, 1991 memorandum from Katy Chaney, Dames & Moore to Allan Giffen. <br />Methodology for the Inventory, Classification and Designation of Geologically Hazardous <br />Areas City of Everett, Washington. <br />• June 5, 2003 Landau Associates Report - Geologically Hazardous Areas Regulation Review. <br />Everett, Washington. <br />• June 2003.
