Documentation on Priority Habitats and Species, <br />including, but not limited to, listings, management recommendations, and maps. <br />• May 31, 2005 Letter from Tia Heim, Perkins Coie (representing Boeing) and Yew Tree <br />Status Evaluation report; and <br />WHEREAS, the City also reviewed guidance from the Washington State Department of <br />Community, Trade and Economic Development, including the Critical Areas Assistance <br />Handbook; and <br />WHEREAS, the City issued a Draft Supplemental Environmental Impact Statement (EIS) <br />(December 30, 2004) and a Final Supplemental EIS (February 18, 2005) on the City's 10 -Year <br />Comprehensive Plan Update. The update included amendments to the critical area background <br />information, policies, and potential implementation measures in the Land Use Element of the <br />Comprehensive Plan to address "best available science" requirements of the GMA; and <br />WHEREAS, the City Council approved the amendments to the Comprehensive Plan and the <br />updated policies took effect on August 10, 2005; and <br />WHEREAS, the SW Everett / Paine Field Subarea Plan and EIS was completed in December <br />1996, and the Ordinances implementing the Plan and Planned Action were completed in March <br />1997; and <br />WHEREAS, a wetland rating system was used in the SW Everett / Paine Field Subarea Plan and <br />EIS and in Ordinance No. 2213-97 that is out-of-date; and <br />WHEREAS, the proposed amendments were reviewed under the State Environmental Policy Act <br />and a Determination of Nonsignificance was issued for the amendments; and <br />WHEREAS, Planning Commission conducted two workshops and two public hearings to review <br />the amendments and to take public testimony, and recommended that the City Council approve <br />the proposed amendments; and <br />WHEREAS, the City Council finds that the proposed amendments to the City's regulations for <br />critical areas in the Zoning Code and Ordinance No. 2213-97 are consistent with the GMA <br />requirements for incorporating Best Available Science (RCW 36.70A.172); and <br />2 <br />
