ORDINANCE NO. 2910-06 <br />AN ORDINANCE Amending Attachment A to Ordinance No. 2213-97, <br />An Ordinance Establishing a Planned Action for Southwest Everett <br />to Require Compliance with Revised Critical Area Regulations (EMC 19.37) <br />WHEREAS, the Washington State Growth Management Act (GMA) requires the City of Everett <br />to designate critical areas and to adopt development regulations to protect critical areas (RCW <br />36.70A.060 and .170 and WAC 365-194-410); and <br />WHEREAS, RCW 36.70A.172 requires that jurisdictions include best available science in <br />developing policies and development regulations to protect the functions and values of critical <br />areas and to give special consideration to conservation or protection measures necessary to <br />preserve or enhance anadromous fisheries; and <br />WHEREAS, the City's best available science review is contained in the following documents <br />and is supported by a comprehensive number of sources as referenced in said documents: <br />• July 1, 1991 memorandum from Katy Chaney, Dames & Moore to Allan Giffen. <br />Methodology for the Inventory, Classification and Designation of Geologically Hazardous <br />Areas City of Everett, Washington. <br />• June 5, 2003 Landau Associates Report - Geologically Hazardous Areas Regulation Review. <br />Everett, Washington. <br />• June 2003.
