• Department of Fish and Wildlife. Documentation on Priority Habitats and Species, <br />including, but not limited to, listings, management recommendations, and maps. <br />• May 31, 2005 Letter from Tia Heim, Perkins Coie (representing Boeing) and Yew Tree <br />Status Evaluation report; and <br />WHEREAS, the City also reviewed guidance from the Washington State Department of <br />Community, Trade and Economic Development, including the Critical Areas Assistance <br />Handbook; and <br />WHEREAS, the City issued a Draft Supplemental EIS (December 30, 2004) and a Final <br />Supplemental EIS (February 18, 2005) on the City's 10 -Year Comprehensive Plan Update. The <br />update included amendments to the critical area background information, policies, and potential <br />implementation measures in the Land Use Element of the Comprehensive Plan to address "best <br />available science" requirements of the GMA; and <br />WHEREAS, the City Council approved the amendments to the Comprehensive Plan and the <br />updated policies took effect on August 10, 2005; and <br />WHEREAS, the SW Everett / Paine Field Subarea Plan and EIS was completed in December <br />1996, and the Ordinances implementing the Plan and Planned Action were completed in March <br />1997; and <br />WHEREAS, a wetland rating system was used in the SW Everett / Paine Field Subarea Plan and <br />EIS and in Ordinance No. 2213-97 that is out-of-date; and <br />WHEREAS, the proposed amendments are more protective of critical areas than the mitigation <br />measures adopted in the Planned Action for SW Everett; and <br />WHEREAS, the proposed amendments were reviewed under the State Environmental Policy Act <br />and a Determination of Nonsignificance was issued for the amendments; and <br />WHEREAS, Planning Commission conducted two workshops and two public hearings to review <br />the amendments and to take public testimony, and recommended that City Council approve the <br />proposed amendments; and <br />WHEREAS, the City Council finds that the proposed amendments to the City's regulations for <br />critical areas in the Zoning Code and Ordinance No. 2213-97 are consistent with the GMA <br />requirements for incorporating Best Available Science (RCW 36.70A.172); and <br />WHEREAS, the City Council finds that the proposed amendments are supported by several goals <br />and policies of the GMA, including reducing sprawl, encouraging growth in urban areas, <br />encouraging economic development, protecting property rights, protecting the environment, open <br />space and recreation areas, and encouraging and coordinating public participation in the planning <br />process; and <br />2 <br />
