Sites that are designated environmentally sensitive may be modified only in compliance with <br />environmentally sensitive area regulations. Disturbance of environmentally sensitive areas to <br />construct necessary utilities will be limited to the minimum necessary for construction. <br />Sites designated as geologically hazardous areas may be modified if approved by the Planning <br />Director based upon review of a geotechnical report that shows the proposal meets the criteria of <br />Section 37 of the Zoning Code. The report must show that the modifications will not create a <br />hazard to the subject property or surrounding properties. <br />IS AMENDED TO READ AS FOLLOWS: <br />All slopes that are not designated critical areas or required buffers may be modified. Major cuts <br />and fills will likely occur to make sites suitable for development. <br />Sites that are designated critical areas or buffers may be modified only in compliance with EMC <br />19.37. Disturbance of critical areas to construct necessary utilities will be limited to the <br />minimum necessary for construction. <br />Sites designated as geologically hazardous areas may be modified if approved by the Planning <br />Director based upon review of a geotechnical report that shows the proposal meets the criteria of <br />Section 37 of the Zoning Code. The report must show that the modifications will not create a <br />hazard to the subject property or surrounding properties. The slopes must also not be designated <br />critical areas for other reasons, such as fish and wildlife conservation areas, or be a buffer for <br />another critical areas. <br />Section 5: Compliance with EMC 19.37 Required. <br />Section 4.1 of Attachment A to Ordinance No. 2213-97, which reads as follows: <br />4.1 Threshold <br />If a priority species is mapped on or within 300 feet of a site or documented on the site by a <br />qualified individual, additional SEPA review may be required. This will require coordination <br />with the Department of Fish and Wildlife to determine appropriate mitigation measures. These <br />may include, but are not limited to, seasonal restriction on construction, provision of buffers, and <br />preservation of existing vegetation. <br />Note: If an endangered plant or wildlife species is found on a site prior to or during <br />development, the developer must comply with all applicable federal, state, and local regulations, <br />including preparation of habitat management plans. (The Subarea Plan preserves priority <br />habitats as defined by the Department of Fish and Wildlife - urban natural open space, riparian <br />corridors, and wetlands.) <br />IS AMENDED TO READ AS FOLLOWS: <br />El <br />
