When such application has been <br /> set for public hearing, the Planning Department or <br /> other appropriate City department shall coordinate and <br /> assemble the comments and recommendations of other City <br /> Departments and governmental agencies having an <br /> interest in the subject application and shall prepare a <br /> report summarizing the factors involved and the <br /> proposed findings and recommendations. At least five <br /> (5) working days prior to the scheduled hearing, the <br /> report shall be filed with the Examiner and copies <br /> thereof shall be mailed to the applicant and shall be <br /> made available for use by any interested party for the <br /> cost of reproduction. Provided, however, for any <br /> appeal heard by the Examiner pursuant to this <br /> ordinance, the following procedure shall apply: <br /> 1 . At least twenty (20) working days prior to the <br /> date of the scheduled hearing on the appeal before <br /> the Examiner, the appellant shall file with the <br /> Office of the Hearing Examiner a memorandum <br /> setting forth the appellant ' s arguments and <br /> authority. Such arguments and authority shall be <br /> restricted to those issues set forth in <br /> appellant' s written appeals statement; <br /> 2 . At least ten (10) working days prior to the date <br /> of the scheduled hearing before the Examiner, City <br /> staff shall file with the Office of the Hearing <br /> Examiner and provide the appellant with a Staff <br /> Report responding to the appellant ' s memorandum <br /> concerning the appeal; and <br /> 3 . At least five (5) days prior to the date of the <br /> scheduled hearing before the Hearing Examiner, the <br /> appellant shall file with the Office of the <br /> Hearing Examiner any reply memorandum which the <br /> appellant desires to file. The scope of the reply <br /> memorandum shall be restricted to responding to <br /> issues raised in the Staff Report. <br /> 11 <br />
