Responsible Official may delay distribution of the <br /> draft EIS, when necessary, to correct any <br /> deficiency in the data submitted, and that the <br /> consultant shall provide such information as is <br /> required under Subsection "a" above. <br /> 3) All fees and charges for said consultant shall be <br /> the responsibility of the applicant. <br /> 4) The Responsible Official shall accept as a <br /> consultant any person, firm, corporation, <br /> partnership or association which: <br /> a. Documents its expertise in engineering, <br /> planning, biology, zoology, geology, and <br /> other areas of analysis under WAC 197-11-444 , <br /> and <br /> b. Where the firm has had previous experience <br /> and provides one or more recommendations from <br /> the lead agency involved in the prior <br /> experiences. <br /> 5) The Responsible Official may, upon notification to <br /> an affected firm refuse to accept said firm as the <br /> consultant for the EIS for good cause including <br /> incompetence, misrepresentation, insufficiency, <br /> bias, or gross failure to perform in accordance <br /> with this Ordinance. The firm shall have the <br /> opportunity to present arguments to the <br /> Responsible Official prior to the Responsible <br /> Official ' s actions and may request a finding and <br /> determination in writing for the purpose of <br /> review. <br /> d. Consultant/Applicant Responsibilities: <br /> When a private applicant or consultant prepares a <br /> Draft, Final, or Supplemental EIS, the following <br /> responsibilities are hereby specified: <br /> 1) City determines the scope of the EIS in compliance <br /> with WAC 197-11-360, and WAC 197-11-408 or WAC <br /> 197-11-410 as appropriate. <br /> 2) City communicates and meets with the developer. <br /> 3) City communicates and meets with the consultant. <br /> 4) Consultant submits information in the form of a <br /> draft EIS. <br /> 10 <br />
