Section VIIC: APPEALS <br /> The City establishes the following administrative <br /> appeal procedures under RCW 43 . 21C. 075 and WAC 197-11- <br /> 680: <br /> 1. For purposes of utilizing SEPA to assist in <br /> governmental decision making, in addition to the <br /> right of appeal under VIIB5 herein, the City <br /> recognizes a right of administrative appeal of a <br /> threshold determination (a DNS or DS) by any <br /> aggrieved person. <br /> A. Any person aggrieved by any of the <br /> determinations or actions of the Responsible <br /> Official as described in this Section and <br /> Section VIIB5 above, may appeal to the City <br /> Council by submitting to the City Clerk a <br /> written statement requesting an appeal which <br /> sets forth the name and address of the person <br /> aggrieved and a clear and concise statement <br /> of the grounds for the appeal. Any appeal <br /> from such a determination or action must be <br /> filed with the City Clerk no later than ten <br /> (10) days following the issuance of the DNS <br /> or DS. <br /> B. Upon timely notice of appeal as to <br /> determination or action set out in Subsection <br /> "A" of this section, the City Council shall <br /> set a date for hearing, which shall be not <br /> less than 20 days nor more than 45 days after <br /> receipt of the request for appeal by the City <br /> Clerk. Within ten working days after such <br /> hearing, the City Council shall file and <br /> transmit to the parties written findings of <br /> fact, conclusion of law and the decision. <br /> C. Notice of hearings shall be sent by certified <br /> mail to the parties concerned and published <br /> in a newspaper of general circulation at <br /> least ten (10) days prior to the hearing. <br /> D. The City Council shall have authority upon <br /> good cause to grant continuances of hearings <br /> not to exceed fourteen (14) days and the City <br /> Council shall have the authority to affirm, <br /> reverse or modify in whole or in part the <br /> administrative determinations of the <br /> Responsible Official with directions for <br /> 26 <br />
