• <br /> • <br /> Authority to let contracts not requiring competitive bidding. <br /> A. The mayor, or designees specifically authorized by the mayor, are <br /> authorized to let or enter contracts not requiring competitive bidding in the <br /> following instances: <br /> 1. Purchases of normal operating goods as necessary to accomplish <br /> the functions established within the appropriations approved by the Everett city <br /> council under the current annual budget. <br /> 2. Purchases of goods or services on an emergency basis. <br /> B. The mayor shall be responsible to assure that all purchases of <br /> goods in the instances specified in subsection A of this section are within the <br /> functions and appropriations established by city council. <br /> C. The city council may at any time by resolution require that the <br /> mayor, or his designee, obtain council approval to let or enter contracts for <br /> certain categories of goods. <br /> D. The Mayor shall submit for Council authorization any professional <br /> or personal service contract in an amount over five hundred dollars ($500.00). <br /> E. The Mayor is authorized to enter into contracts for emergency <br /> professional or personal service or goods that are needed to protect the City <br /> from liability provided the Mayor receives prior verbal approval from the Council <br /> Budget Committee or three (3) City Council members. Such emergency contract <br /> entered into by the Mayor shall be valid only until the next scheduled Council <br /> meeting following the emergency, at which time the contract with full <br /> documentation of the emergency shall be presented to the City Council Budget <br /> Committee for review and approval, and then to the City Council. Council shall <br /> approve or disapprove the contract. Council's disapproval shall result in the <br /> contract immediately becoming void and unenforceable prospectively. <br /> F. Except as provided in subsections A and E of this section, all <br /> contracts for professional and personal service, and goods, shall be reviewed <br /> and approved by the City Council Budget Committee prior to their consideration <br /> by Council. <br /> Section 2: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this <br /> ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect the <br /> validity of the remaining portions of this ordinance or its application to any other <br /> person or situation. The City Council of the City of Everett hereby declares that <br /> it would have adopted this ordinance and each section, subsection, sentence, <br /> clause, phrase or portion thereof irrespective of the fact that any one or more <br /> sections, subsections, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br /> 2 <br />
