insured. Such insurance shall be cancelable only <br /> after thirty (30) days written notice to the City <br /> of Everett. Cancellation or voiding of <br /> applicant's insurance policy by whatsoever means <br /> shall automatically cancel said applicant' s <br /> authority granted herein. <br /> SECTION 3 : Section 3 of Ordinance No. 3604 (EMC 13 . 40. 030) <br /> which reads as follows: <br /> Section 3 : Any person hanging or suspending <br /> any sign, banner or decoration across the public <br /> streets and thoroughfares of the City of Everett <br /> without a license at such time as permitted in <br /> this ordinance shall be guilty of a violation of <br /> this ordinance. <br /> be and the same is hereby amended to read as follows: <br /> Section 3 : Any person hanging or suspending <br /> any sign, banner or decoration across the public <br /> streets and thoroughfares of the City of Everett <br /> without compliance with the provisions of this <br /> ordinance and any rules adopted pursuant thereto <br /> shall be guilty of a misdemeanor punishable by a <br /> fine not to exceed one thousand dollars per day. <br /> Each day upon which a violation occurs or <br /> continues shall constitute a separate violation. <br /> In addition to the penalties provided herein, the <br /> City is authorized to remove any sign, banner or <br /> decoration hung or suspended in violation of this <br /> ordinance and the City may recover all reasonable <br /> costs and fees associated with the removal and all <br /> court costs, attorney' s fees and other expenses of <br /> litigation against the person, firm or corporation <br /> found to have violated the provision of this <br /> ordinance. <br /> SECTION 4 : Section 4 of Ordinance No. 3604 is hereby <br /> repealed. <br /> SECTION 5: SEVERABILITY <br /> Should any section, subsection, paragraph, sentence, clause or <br /> phrase of this ordinance or its application to any person or <br /> situation be declared unconstitutional or invalid for any reason, <br /> such decision shall not affect the validity of the remaining <br /> portions of this ordinance or its application to any other person <br /> or situation. The City Council of the City of Everett hereby <br /> declares that it would have adopted this ordinance and each <br /> section, subsection, sentence, clause, phrase or portion thereof <br /> 3 <br />
