• <br /> G. Infill dwellings are allowed a height up to 24 feet in the <br /> R-3H zone and 34 feet in the R-4H zone. <br /> Section 15: Amendment of Neighborhood Conversation Guidelines. <br /> "Neighborhood Conservation Guidelines for the Rucker and Grand Avenues <br /> Historic Zone" are hereby adopted. The guidelines are to be used in <br /> the review of construction and development within the Rucker and Grand <br /> Avenues Historic Overlay Zone as described in Section 5 of this <br /> Ordinance. The "Neighborhood Conservation Guidelines" may be amended <br /> as necessary by the Mayor's designee, the Planning Director, following <br /> recommendation from the Historical Commission, to further the goals of <br /> preserving the historic character of the neighborhood. The current <br /> "Neighborhood Conservation Guidelines" shall be maintained on file in <br /> the office of the Planning Department. <br /> Section 16: Inventory of Affected Properties. An "Inventory of the <br /> Rucker and Grand Avenue Historic Overlay Zone" is hereby adopted, <br /> which lists the properties within the district which are historically <br /> significant or which contribute to the historic character of the <br /> district, to be used to identify those properties which are subject to <br /> the regulations specified in this Ordinance. The "Inventory of the <br /> Rucker and Grand Avenue Historic Overlay Zone" may be amended as <br /> necessary by the Mayor's designee, the Planning Director, following <br /> recommendation from the Historical Commission. The current "Inventory <br /> of the Rucker and Grand Avenue Historic Overlay Zone" shall be <br /> maintained on file in the office of the Planning Department. <br /> Section 17: Severability. If any section, subsection, clause, phrase <br /> or any portion of this ordinance is for any reason held to be invalid <br /> or unconstitutional by the decision of any court of competent <br /> jurisdiction, such decision shall not affect the validity of the <br /> remaining portions of this ordinance. The City Council of the City of <br /> Everett hereby declares that it would have adopted this ordinance and <br /> each section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or portions be declared invalid <br /> or unconstitutional. <br /> Section 18: Savings Clause. Nothing contained in this Ordinance <br /> shall be construed as abating any action now pending under of by <br /> virtue of any ordinance of the City herein superseded; or as <br /> discontinuing, abating, modifying or altering any penalty accrued or <br /> to accrue, ar as affecting the liability of any person, firm, or <br /> corporation, or as waiving any right of the City under any ordinance <br /> or provision thereof in force at the time of passage of this <br /> Ordinance. <br /> 8 <br />
