• G. Infill dwellings are allowed a height up to 24 feet in the R-3H zone and 34 feet in the R-4H zone. Section 15: Amendment of Neighborhood Conversation Guidelines. "Neighborhood Conservation Guidelines for the Rucker and Grand Avenues Historic Zone" are hereby adopted. The guidelines are to be used in the review of construction and development within the Rucker and Grand Avenues Historic Overlay Zone as described in Section 5 of this Ordinance. The "Neighborhood Conservation Guidelines" may be amended as necessary by the Mayor's designee, the Planning Director, following recommendation from the Historical Commission, to further the goals of preserving the historic character of the neighborhood. The current "Neighborhood Conservation Guidelines" shall be maintained on file in the office of the Planning Department. Section 16: Inventory of Affected Properties. An "Inventory of the Rucker and Grand Avenue Historic Overlay Zone" is hereby adopted, which lists the properties within the district which are historically significant or which contribute to the historic character of the district, to be used to identify those properties which are subject to the regulations specified in this Ordinance. The "Inventory of the Rucker and Grand Avenue Historic Overlay Zone" may be amended as necessary by the Mayor's designee, the Planning Director, following recommendation from the Historical Commission. The current "Inventory of the Rucker and Grand Avenue Historic Overlay Zone" shall be maintained on file in the office of the Planning Department. Section 17: Severability. If any section, subsection, clause, phrase or any portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or portions be declared invalid or unconstitutional. Section 18: Savings Clause. Nothing contained in this Ordinance shall be construed as abating any action now pending under of by virtue of any ordinance of the City herein superseded; or as discontinuing, abating, modifying or altering any penalty accrued or to accrue, ar as affecting the liability of any person, firm, or corporation, or as waiving any right of the City under any ordinance or provision thereof in force at the time of passage of this Ordinance. 8
