applicant would not operate the for-hire vehicle in a <br /> safe manner; <br /> 5. That the applicant has failed to meet any of <br /> the qualifications listed in Section 13 of this <br /> ordinance; or <br /> 6. That the applicant was incarcerated pursuant <br /> to a conviction as noted in Section 13 of this <br /> ordinance and is under the supervision of the <br /> Department of Corrections at the time of application as <br /> a result of said conviction. <br /> C. Any applicant whose for-hire vehicle driver's <br /> license is rejected may appeal by filing written notice <br /> with the parking hearing examiner within ten working <br /> days from the date the notice of rejection is sent by <br /> the city. The parking hearing examiner may exercise <br /> its discretion in granting or renewing such license. <br /> SECTION 2 : SEVERABILITY. <br /> Should any section, subsection, paragraph, sentence, clause or <br /> phrase of this ordinance or its application to any person or <br /> situation be declared unconstitutional or invalid for any reason, <br /> such decision shall not affect the validity of the remaining <br /> portions of this ordinance or its application to any other person <br /> or situation.
