ORDINANCE NO. 2912-06 An Ordinance concerning the Municipal Arts Fund, amending Sec. 3C of Ordinance No. 1471-88 (EMC 2.95.030(c)) and adding a new subsection thereto WHEREAS, Ordinance No. 1471-88 provides that one percent of the total project cost of each municipal construction project be contributed to the Municipal Arts Fund for the purpose of making appropriations for the development of arts and culture in the City of Everett; and WHEREAS, the City Council finds it necessary to amend Ordinance No. 1471-88 to clarify the formula for calculating the amount to be contributed to the Municipal Arts Fund; and WHEREAS, the formula as currently stated in Ordinance No. 1471-88 creates unnecessary confusion about whether the one percent contribution should be based off the bid award rather than the total amount of funds appropriated for the project; and WHEREAS, the practice of waiting until bid awards are made to calculate and transfer the one percent contribution to the Municipal Art Fund tends to make it difficult for the Everett Cultural Commission to plan or budget for its expenditures; and WHEREAS, clarification of the formula and elimination of a project -by - project basis for determining when funds will be ineligible for inclusion in total project cost will assist the City's Finance Department in calculating the one percent contribution in a manner that is consistent with the intent of Ordinance No. 1471-88 and that avoids questions about the percentage of monies to be transferred to the Municipal Arts Fund; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: p.1 of 3
