Section 1: Section 3C of Ordinance No. 1471-88 (EMC 2.95.030 (C)), which currently reads as follows: The one percent (1 %) figure shall be calculated as follows: 1 % multiplied by Total Project Cost per bid award multiplied by the percent of Total Project Cost paid by eligible funds as described herein, is hereby amended to read as follows: The one percent (1 %) figure shall be calculated as follows: 1 % multiplied by Total Project Cost peF bid aw multiplied by the percent of Total Project Cost paid by eligible funds as described herein. Section 2: Ordinance No.1471-88 (EMC 2.95.030 (C)) shall be further amended to add a new subsection 3A(3) to read as follows: The one percent contribution to the Municipal Arts Fund based on any transit or related fund shall be calculated and transferred in a manner that allows the one percent contribution based on such funds to be maintained separately and ensures that these funds are only used to pay for art projects that bear a sufficiently close nexus to transit facilities or the purpose of transit. Section 3 - If any section, subsection, clause, sentence, or phrase of this Ordinance should be held invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. Section 4: Nothing contained in this Ordinance is intended to be nor shall be construed to create or otherwise establish any particular class or group of persons who will or should be especially protected or benefited by the provisions in this Ordinance. This Ordinance is not intended to be, nor shall be, construed to create any basis for liability on the part of the City, its officers, employees or agents ("City") for any injury or damage that an individual, class or group may claim arises from any action or inaction on the part of the City. p.2 of 3
