The Customer will not take from the PUD, and the PUD will have no <br /> obligation under any circumstances to deliver to the Customer, more than such maximum 2,600 kVA of <br /> Electric Power at any time. This Section applies during normal operating conditions—i.e.,when Bank#1 <br /> is supplied by one feeder and when Bank#2 is supplied by another separate feeder. <br /> 3.3. Connected Load. The Customer's connected load is 2,449 kW based on the Customer's <br /> connected equipment effective on the date of this Contract or identified in the load summary dated <br /> September 21, 2010 that was provided by the Customer (see Exhibit A, Electrical Loads, AWWD PS 1 <br /> and PS 2,Everett EWPS). The amount of connected load will be used to determine the minimum charge. <br /> 3.4. Voltage. The PUD will deliver Electric Power to the Customer at a nominal secondary <br /> voltage of approximately 2,400 volts with operating limits of between plus or minus 5 percent. <br /> 3.5. Point of Delivery. The point of delivery for Electric Power under this Contract(the <br /> "Point of Delivery") is the termination of the secondary cable located at load break switch number 5185 <br /> for the City of Everett, and 5186 and 5187 for the Alderwood Water and Wastewater District. <br /> 4. RATES AND CHARGES <br /> 4.1. Rates Payable. The Customer agrees to pay to the PUD the rates and charges in the <br /> Schedules in consideration for the Electric Power and other products and services furnished by the PUD <br /> under this Contract, including the regular charge, minimum charge, and applicable taxes and surcharges. <br /> In the event the Commission revises a Rate Schedule applicable to Customer, the Customer agrees to <br /> thereafter pay for Electric Power provided by the PUD in accordance with the revised Rate Schedule. <br /> 5. SPECIAL CONDITIONS RELATING TO SERVICE DELIVERY. <br /> In addition to the other terms and conditions set forth in this Contract, the Parties agree to the following <br /> special conditions of service or special operational requirement for the Evergreen Way Pumping Station <br /> (EWPS): <br /> 5.1 The PUD, by the language in this section, is establishing a level of service agreement at <br /> the EWPS. This agreement will be implemented upon completion of the new service to the EWPS and <br /> the second power feed with associated switches and configuration requirements under a separate contract <br /> (the "Highway Place Substation Improvement Material Procurement and Construction Contract") <br /> between the AWWD and the PUD, which contract is the subject of a separate agreement between the <br /> Customer and AWWD. An Operating Agreement to be signed by the PUD, the Customer and the <br /> AWWD is also required before this,secondary service contract is implemented. <br /> 5.2 The PUD will maintain, under normal operating conditions,one circuit from the 52nd St. <br /> Substation feeding transformer Bank#1 and the other circuit from Pinehurst Substation feeding <br /> transformer Bank#2. This means that the load will be"split" and the secondary tie switch between both <br /> transformer banks will be in the open position and the primary voltage tie switch will be in the open <br /> position under normal operating conditions. The PUD circuits shall not be tied together using the <br /> secondary or primary tie switches during normal operating conditions. If a circuit outage occurs,the PUD <br /> ' 7,600 kVA is the maximum projected demand for the EWPS site through 2040, as identified in a September 29, <br /> 2010 e-mail from AWWD(see Exhibit B,Table,Column 2,"Maximum Projected Load 2015-2040"). <br /> 2 <br /> 49 <br />
