Section 3: Ordinance No. 1671-89, as amended (EMC 19.5, Table 5.2 Special Regulations, is <br /> amended by the addition of the following special regulations: <br /> (68) "Electric vehicle charging stations—restricted" are allowed in this zone only as an accessory <br /> use to a permitted residential use, or through Review Process II for a permitted non-residential <br /> use, as defined in this Title. In all residential zones, electric vehicle charging stations must meet <br /> minimum building setback requirements for accessory structures. <br /> (69) In the B-3 zone electric vehicle charging stations are prohibited within the public right-of- <br /> way on streets designated `Retail' on Map 22-2. Electric vehicle charging stations located on a <br /> lot fronting on a street designated as "Retail Street"by Map No. 22-2 shall not be visible from <br /> the public sidewalk abutting the lot. <br /> Section 4: Annual Report. The Planning Director shall provide an annual report to the City <br /> council on the status of electric vehicle charging stations. The report shall include information <br /> concerning the number of permits issued for electric vehicle charging stations, and any recommended <br /> changes to the zoning code based on issues that may arise with the new technology that were not <br /> anticipated at the time of adoption of this regulation. <br /> Section 5: Severability. Should any section, paragraph, clause or phrase of this Ordinance, or its <br /> application to any person or circumstance, be declared unconstitutional or otherwise invalid for any <br /> reason, or should any portion of this Ordinance be pre-empted by state or federal law or regulations, <br /> this shall not affect the validity of the remaining portions of this Ordinance or its application to other <br /> persons or circumstances. <br /> Section 6: Conflict. In the event there is a conflict between the provisions of this Ordinance and <br /> any other City ordinance, the provisions of this Ordinance shall control. <br /> Section 7: Corrections. The City Clerk and the codifiers of this Ordinance are authorized to make <br /> necessary corrections to this Ordinance including, but not limited to,the correction of <br /> scrivener's/clerical errors, references, ordinance numbering, section/subsection number and any <br /> references thereto. <br /> Ray Stephanson, Mayor <br /> ATTEST: <br /> CITY CLERK <br /> Passed: <br /> Valid: <br /> Published: <br /> Effective Date: <br /> 6 <br />
