FINDINGS OF FACT <br /> 1. The Appellant has appealed the Fire Department's decision requiring an <br /> approved automatic fire detection system in the Speedway Machine building. <br /> 2. The building is a newly constructed single story 6000 + square foot building, <br /> constituting a group B occupancy. <br /> 3. The project is within the thresholds requiring a SEPA review. <br /> 4. The SEPA Determination included the requirement for an approved automatic fire <br /> detection system. <br /> 5. The building permit for the project included the requirement for an approved <br /> automatic fire detection system. <br /> 6. A Certificate of Occupancy was issued for the building based partially on an <br /> approval by the Fire Department. <br /> 7. The Fire Department performed a subsequent inspection of the building, issuing a <br /> correction notice to install an approved automatic fire detection system. <br /> 8. Section 3 of Ordinance No. 1902-92 requires buildings over 3000 square feet of <br /> gross floor area to have an approved fire detection system. <br /> 9. The Appellant contends that: (1) Notice was defective; (2) Ordinance No. 1902- <br /> 92 does not apply; (3) System was accepted; and (4) Ordinance No. 1902-92 <br /> authorizes the fire inspector to waive this requirement. <br /> 10. The Fire Department contends that: 1) Ordinance No. 1902-92 applies to the <br /> automatic fire detection system requirement since this is a group B occupancy <br /> exceeding 3,000 sq. ft of gross floor area; (2) that the Appellant only installed a <br /> fire suppression system that did not include an automatic fire detection system; <br /> and (3) that the Fire Department did not waive the automatic fire detection system <br /> requirement nor did it have the authority to do so. <br /> CONCLUSIONS <br /> 1. Ordinance No. 1902-92 applies to this building. <br /> 2. Section 3 of Ordinance No. 1902-92 requires an approved fire detection system in <br /> buildings over 3000 square feet in gross floor area and this buildings exceed that <br /> threshold. <br /> �3 <br />
