2 <br /> ORDINANCE NO. <br /> AN ORDINANCE providing for the vacation of that portion of <br /> 11`h Street lying west of Grand Avenue. <br /> WHEREAS, Christian H. and Shirley J. Sievers, owners of 1030 Grand Ave, and James R. <br /> Startup, owner of 1102 Grand Ave, (collectively, the"Petitioners") did petition for the vacation <br /> of certain rights-of-way in the City; and <br /> WHEREAS, after properly holding a public hearing and accepting the public's comments, the <br /> City Council determined that the public interest would best be served by granting the petition <br /> and vacating the rights-of-way, but retaining an easement over a portion of the vacated rights-of- <br /> way for the purpose of water views, as provided for in this ordinance; and <br /> WHEREAS, it became clear to staff that the Petitioners would be willing to restrict development <br /> to single-family with accessory structures, by covenant, thereby allaying concerns that the <br /> vacation would allow denser development on the abutting properties; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Vacation. <br /> Subject to the reservation of the Easement described in Section 2, the following described rights- <br /> of-way; <br /> Beginning at the northwest corner of Lot 16, Block 224, Plat of The Heights <br /> Addition to Everett recorded in Volume 3 of Plats, Page 40, records of Snohomish <br /> County, Washington; Thence easterly along the north line of said Lot 16 and the <br /> easterly projection thereof a distance of 145feet to intersect the west line of Grand <br /> Avenue right of way, said west line of Grand Avenue right of way being resultant <br /> of City of Everett Ordinance #89 approved on January 24, 1894, in which the <br /> Page 1 ,? 4 <br />
