7 <br /> WHEREAS,the CITY and the CONSULTANT agree that an additional fee is necessary <br /> to perform the work of additional project design, construction document development and <br /> construction administration. <br /> NOW,THEREFORE,the CITY and the CONSULTANT mutually agree as follows: <br /> Section 1 of the Agreement is modified to change"Exhibit A,A-1, and A-2—Scope of <br /> Work"to Exhibit A, A-1, A-2,and A-3 —Scope of Work." <br /> Section 3 of the Agreement, as amended(Time of Beginning and Completion of <br /> Performance), is modified to change the completion date from December 31, 2011 to <br /> May 31, 2012. <br /> Section 4B of the Agreement is modified to change "Exhibit B, B-1 and B-2 - <br /> Compensation"to Exhibit B,B-1,B-2 and B-3 - Compensation." <br /> Section 4D of the Agreement is modified to change the total compensation, including all <br /> services and expenses from a not to exceed maximum of Two Hundred Sixty Nine <br /> Thousand Five Hundred Sixty One Dollars ($269,561.00)to a not to exceed maximum of <br /> Three Hundred Twenty Eight Thousand Seven Hundred Twenty Six Dollars <br /> ($328,726.00). <br /> Section 6 of the Agreement is modified to change "Exhibit A, A-1, and A-2 — Scope of <br /> Work"to "Exhibit A,A-1,A-2 and A-3 —Scope of Work." <br /> Exhibit A, A-1 and A-2 Scope of Work to the Agreement is modified(attached as Exhibit <br /> A-3 — Scope of Work) to add additional services to the design development and <br /> construction document phases to coordinate and develop revisions to civil, mechanical <br /> and electrical phases resulting from changes to the project as a result of discovery during <br /> the shell and core improvements to the Former Key Bank; and to add construction <br /> administration services for coordination of construction activities on the plaza site. <br /> Exhibit B Compensation to the Agreement is modified (attached as Exhibit B-3 — <br /> Compensation) to increase fee payment for additional services related to design <br /> development and construction document development and for construction administration <br /> services. The additional services increase the not to exceed amount of the contract from <br /> Two Hundred Sixty Nine Thousand Five Hundred Sixty One Dollars ($269,561.00) to an <br /> amount not to exceed Three Hundred Twenty Eight Thousand Seven Hundred Twenty <br /> Six Dollars ($328,726.00). <br /> All other terms and conditions of the agreement, as amended, shall remain in full force <br /> and effect. <br /> IN WITNESS WHEREOF, the CONSULTANT and the CITY have executed this <br /> Agreement as of the day and year first above written. <br /> 2 <br /> 97 <br />
