18 <br /> 7. HOLD HARMLESS <br /> Each party shall defend, protect and hold harmless the other party from and against all claims, <br /> suits or actions arising from any intentional or negligent act or omission of that party's <br /> employees, agents and/or authorized subcontractor(s) while performing under the terms of this <br /> agreement. <br /> 8. SAVINGS <br /> In the event funding from state, federal or other sources is withdrawn, reduced, or limited in any <br /> way after the effective date of this agreement and prior to project completion, the either party <br /> may terminate the agreement under Section No. 12, Termination, subject to renegotiation under <br /> those new funding limitations and conditions. <br /> 9. ORDER OF PRECEDENCE <br /> In the event of an inconsistency in this agreement, unless otherwise provided herein, the <br /> inconsistency shall be resolved by giving precedence in the following order: <br /> a) Applicable Federal and State statutes and regulations; <br /> b) General Terms and Conditions; <br /> c) Statement of Work; and <br /> d) Any other provision of the agreement whether incorporated by reference or <br /> otherwise. <br /> 1.
