The <br /> proposed code amendment, which has been reviewed by the Legal Department, would be added to the <br /> General Provisions chapter of the code. <br /> The proposed Ordinance would explicitly authorize the Planning Director or Building Official to require a <br /> survey for new or expanded structures. Staff would retain discretion to vary the scope of the survey or waive <br /> the requirement where it consitutes an unnecessary expense. However,the proposed Ordinance provides that <br /> the survey requirement should not be waived, absent extraordinary circumstances, where the proposed <br /> structure is within one foot of a required setback or the maximum allowable height. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Adopt Ordinance Amending the Zoning Code to Provide for Verification that New or Expanded Structures <br /> Comply with Zoning Standards for Maximum Height and Minimum Setbacks, Amending Ordinance No. <br /> 1671-89, as amended (EMC Title 19). <br /> 1 <br />
