5. This proposed Comprehensive Plan map amendment and rezone to P (Public Park) promotes the best long term interest of the Everett community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Approval of Comprehensive Plan Land Use Map Designation Change. Ordinance No. 2021-94, as amended, is hereby amended as follows: The City of Everett Comprehensive Plan Land Use Map is changed from 1.3 (Single Family Detached)to 2.0 (Parks/Public Open Space) as shown on Exhibit 1 for Century Park. Section 2: Approval of Rezone. Ordinance No. 1671-89, as amended (EMC 19.02.020), is hereby amended to implement the new comprehensive plan designation as follows: The City of Everett Zoning Map depicting Century Park is changed from R-2 to P (Public Park) as shown on Exhibit 2. Section 3: Incorporation. Exhibits 1 and 2 are hereby made part of this approval and incorporated herein by reference. Section 4: Severability. Should any section, paragraph, clause or phrase of this Ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this Ordinance be pre-empted by state or federal law or regulations, this shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or circumstances. Section 5: Conflict. In the event there is a conflict between the provisions of this Ordinance and any other City ordinance, the provisions of this Ordinance shall control. - 3 -
