ORDINANCE NO. 3 5 41-17 <br /> An Ordinance Amending the Comprehensive Plan Map Designation <br /> With a Rezone for the Property Located at 12704 19th Avenue SE, <br /> Amending Ordinance No's. 2021-94 and 1671-89,As Amended <br /> WHEREAS,the City Council finds the following: <br /> 1. The Washington State Growth Management Act (GMA) requires counties and cities to <br /> prepare comprehensive plans pursuant to RCW 36.70A; and <br /> 2. The City adopted a Comprehensive Plan in August, 1994, in conformance with the <br /> Washington State Growth Management Act, and completed its 10 year update to the <br /> Comprehensive Plan on October 21, 2015; and <br /> 3. RCW 36.70A allows for comprehensive plans to be amended on an annual basis; and <br /> 4. The City received a request on June 17, 2016 by Builder's Investment Group, LLC to <br /> amend the Comprehensive Plan Map designation from 1.3: Single Family Detached to <br /> 4.4: Mixed-Use Commercial/Multiple-Family with a Rezone from R-2: Single Family <br /> Medium Density to C-1: General Commercial for their property located at 12704 19th <br /> Avenue SE; and <br /> 5. The City of Everett initiated its 2016—2017 annual comprehensive plan amendment <br /> process in July of 2016, which included consideration of Land Use Map amendments <br /> and rezone applications initiated by property owners and the Everett Planning <br /> Commission; and <br /> 6. In order to carry out the recommended change,the Comprehensive Plan designation of <br /> the subject property must be amended from 1.3: Single Family Detached to 4.4: Mixed- <br /> Use Commercial/Multiple Family, see Exhibit"A", and the zoning must be changed from <br /> R-2: Single Family Medium Density to C-1: General Commercial; and <br /> 7. Staff did meet with the Silver Lake neighborhood regarding this proposal on September <br /> 20, 2016; and <br /> 8. The Planning Commission held public hearings on the matter on December 6, 2016 and <br /> March 7, 2017, at which time it heard from the public and staff, and considered the <br /> proposal and did recommend approval for a single and appropriate Comprehensive Plan <br /> designation and zone on the property, subject to conditions stated in a development <br /> agreement between the applicant and the City; and <br /> Page 1 of 14 <br />
