9. The Land Use element of the comprehensive plan includes the following policy that is <br /> particularly relevant to the proposed change to the land use map: <br /> Policy 2.1.3 Strongly discourage the conversion of residential areas to nonresidential <br /> uses. Discourage the encroachment of commercial uses into residential zones, except in <br /> the following circumstances: <br /> (d) conversion of residentially designated properties to commercial use may be <br /> permitted for the redevelopment of existing commercial uses where (i)the redevelopment <br /> is necessary to preserve the economic viability of an existing commercial use that serves <br /> the community; (ii)the commercial redevelopment is part of a unified commercial <br /> development that includes coordinated architectural design, site and parking layout, <br /> landscaping, access, drainage, and utilities; and (iii)the redevelopment includes elements <br /> that address potential impacts on adjacent residential uses. <br /> and <br /> WHEREAS,the City Council concludes the following: <br /> 1. The purpose for the requested Comprehensive Plan land use map amendment is to provide <br /> consistency between the Comprehensive Plan map and the zoning map, and to provide <br /> the designation and zone for this property to match its anticipated use; <br /> 2. The Planning Commission held public hearings on this proposal on December 6, 2016, <br /> and March 7, 2017, and passed Resolution 16-11 and Resolution 17-05, recommending <br /> adoption of these actions by City Council; <br /> 3. The requested action is supported by, or consistent with, the Comprehensive Plan as <br /> required by Chapter V of the Land Use element (C) Guide to Decision Making, "All <br /> zoning decisions must by law be consistent with the comprehensive Plan." This action is <br /> specifically intended to make the subject area's zoning and comprehensive plan <br /> designation consistent after the proposed changes are made; <br /> 4. The changed circumstances and new information related to the property justify the <br /> changes to the land use designation; <br /> 5. The proposed designation is consistent with the existing designation of abutting properties <br /> to the south; <br /> 6. The change promotes and ensures a desired land use pattern because the change in land <br /> use will support the current use on the commercial property abutting to the south with the <br /> requirement for a Development Agreement between the applicant and the City; <br /> 7. The proposed land use designation should not be applied to other properties in the vicinity <br /> without first meeting the policies of the Comprehensive Plan on their own merit and <br /> considered separately from this action. Therefore, approval of this application would not <br /> constitute a granting of special privilege; <br /> Page 2 of 14 <br />
