• <br /> It is the specific intent to these regulations to place <br /> the obligation of complying with these regulations upon <br /> the permit applicant and any person owning, operating <br /> or controlling any building or structure within its <br /> scope. No provision nor term used in this Code is <br /> intended to impose any duty whatsoever upon the City or <br /> any of its officers or employees for whom the <br /> implementation or enforcement of this Code shall be <br /> discretionary and not mandatory. <br /> Nothing in this Code is intended to be nor shall be <br /> construed to create or form the basis for any liability <br /> on the part of the City or its officers, employees or <br /> agents, for any injury or damage resulting from the <br /> failure of a building to comply with the provisions of <br /> this Code, or by reason or in consequence of any <br /> inspection, notice, order, certificate, permission or <br /> approval authorized or issued or done in connection <br /> with the implementation or enforcement of this Code, or <br /> by reason of any action of the City related in any <br /> manner to the enforcement of this Code by its officers, <br /> employees or agents. <br /> Notwithstanding any language used in this Code, it is <br /> not the intent of the Code to create a duty and/or <br /> cause of action running to any individual or <br /> identifiable person but rather any duty is intended to <br /> run only to the general public. <br /> B. Section 203 (a) of the 1991 Edition of the Uniform Mechanical <br /> Code is hereby amended by deleting: <br /> In order to hear and decide appeals of orders, <br /> decisions or determinations made by the Building <br /> Official relative to the application and interpretation <br /> of this code, there shall be and is hereby created a <br /> Board of Appeals consisting of members who are <br /> qualified by experience and training to pass upon <br /> matters pertaining to building construction and who are <br /> not employees of the jurisdiction. The Building <br /> Official shall be an ex officio member of and shall act <br /> as secretary to said Board but shall have no vote upon <br /> any matter before the Board. The Board of Appeals <br /> shall be appointed by the governing body and shall hold <br /> office at its pleasure. The Board shall adopt rules of <br /> 2 <br />
