4401EVE?ETT ORDINANCE NO. 1881-92 AN ORDINANCE providing for the adoption of the 1991 Edition of the Uniform Building Code and the Uniform Building Code Standards, and repealing Ordinance Nos. 1753-90 and 1612-89 . THE CITY OF EVERETT DOES ORDAIN: SECTION 1: This Ordinance shall be known as the "Everett Building Code. " SECTION 2 : There is hereby established in the City of Everett, the Building Division which shall be under the jurisdiction of the Building Official, designated by the Mayor. SECTION 3 : The Uniform Building Code (hereinafter referred to as "UBC") , including Appendix Chapters 7, 32 , 35, 49 , and 70 and the Uniform Building Code Standards (hereinafter referred to as "UBCS") , published by the International Conference of Building Officials, as amended by WAC 51-20 & 21, being particularly the 1991 Editions thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended are hereby adopted by reference and incorporated herein as fully as if set out at length herein. SECTION 4 : Amendments made in the Uniform Building Code and the Uniform Building Code Standards follow: A. Section 204 (a) of the 1991 Edition of the UBC is hereby amended by deleting: Section 204 (a) General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals consisting of members who are qualified by experience and training to pass on matters pertaining to building construction and who are not employees of the jurisdiction. The building official shall be an ex officio member to and shall act as secretary to said board but shall have no vote on any matter before the board. The board of appeals shall be appointed by the governing body and shall hold office at its pleasure. The Board shall adopt rules of procedure for conducting its business, and shall render all decisions and findings in writing to the appellant with a duplicate copy to the building official .
