The Planning Director, using Review Process II.B, may <br /> allow an atrium appurtenance which does not increase <br /> the floor area of the building but which allows for <br /> passive solar energy usage to exceed the maximum <br /> building height allowed by the zone in which the <br /> subject property is located by not more than twenty <br /> percent of the maximum permitted building height. In <br /> reviewing such a proposal, the Planning Director shall <br /> not approve the proposed building appurtenance if it <br /> would significantly obstruct views from and solar <br /> access for surrounding properties. <br /> Section 6: Section 41. 180.E of Ordinance 1671-89 , which reads: <br /> E. Appeals - Filing Period. All appeals provided for in <br /> Paragraphs B and C of this Ordinance shall be filed with the <br /> Planning Department within ten days from the date the <br /> Planning Director issues his/her decision. <br /> is hereby amended to read: <br /> E. Appeals - Filing Period. All appeals provided for in <br /> Paragraphs B and C of this Ordinance shall be filed with the <br /> Planning Department within ten days from the date the <br /> Planning Director issues his/her decision. All appeals must <br /> be filed on forms provided by the Planning department and <br /> will not be considered valid unless the appeal form is <br /> filled out clearly and legibly and is accompanied by the <br /> applicable filing fee. <br />
