. . . : <br /> l'i-: ::mi <br /> • <br /> EVERETT <br /> Aliii <br /> ORDINANCE NO. 1860-92 <br /> AN ORDINANCEprovidinginterim zoning regulations for <br /> adult bookstores, adult retail stores and adult <br /> video stores, and amending Section 39 . 025 of <br /> Ordinance No. 1671-89 (EMC 19 . 39 . 025) . <br /> WHEREAS, the City Council finds that in 1986 the City adopted <br /> adult use business zoning regulations; and <br /> WHEREAS, the City Council finds that currently included within <br /> the City's definition of adult use business are adult bookstores <br /> and adult retail stores; and <br /> WHEREAS, the City Council finds that the recent case of World <br /> Wide Video v. Tukwila, 117 Wn. 2d 382 (Sept. 1991) found that <br /> Tukwila improperly regulated adult use businesses with <br /> predominantly take-home merchandise; and <br /> WHEREAS, the City Council finds that based upon the case of World <br /> Wide Video v. Tukwila, the City should review its regulations of <br /> adult use businesses with predominantly take-home merchandise; <br /> and <br /> WHEREAS, the City Council finds that it is in the interest of the <br /> public health, safety and welfare of the City to adopt interim <br /> zoning regulating adult use businesses with predominantly take- <br /> home merchandise to act as a stop gap measure enabling the City <br /> to review the issue; and <br /> WHEREAS, the City Council finds that: <br /> 1. The proposed amendment is not in conflict with any <br /> of the provisions of the Everett General Plan; and <br /> 2 . The proposed amendment bears a substantial <br /> relation to the public welfare; and <br /> 3 . The proposed amendment promotes the best long term <br /> interests of the Everett Community; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Section 39 . 025 of Ordinance No. 1671-89 (EMC <br /> 19 . 39 . 025) is hereby amended by the addition of the following <br /> subsection: <br />
