. . . : l'i-: ::mi • EVERETT Aliii ORDINANCE NO. 1860-92 AN ORDINANCEprovidinginterim zoning regulations for adult bookstores, adult retail stores and adult video stores, and amending Section 39 . 025 of Ordinance No. 1671-89 (EMC 19 . 39 . 025) . WHEREAS, the City Council finds that in 1986 the City adopted adult use business zoning regulations; and WHEREAS, the City Council finds that currently included within the City's definition of adult use business are adult bookstores and adult retail stores; and WHEREAS, the City Council finds that the recent case of World Wide Video v. Tukwila, 117 Wn. 2d 382 (Sept. 1991) found that Tukwila improperly regulated adult use businesses with predominantly take-home merchandise; and WHEREAS, the City Council finds that based upon the case of World Wide Video v. Tukwila, the City should review its regulations of adult use businesses with predominantly take-home merchandise; and WHEREAS, the City Council finds that it is in the interest of the public health, safety and welfare of the City to adopt interim zoning regulating adult use businesses with predominantly take- home merchandise to act as a stop gap measure enabling the City to review the issue; and WHEREAS, the City Council finds that: 1. The proposed amendment is not in conflict with any of the provisions of the Everett General Plan; and 2 . The proposed amendment bears a substantial relation to the public welfare; and 3 . The proposed amendment promotes the best long term interests of the Everett Community; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: Section 39 . 025 of Ordinance No. 1671-89 (EMC 19 . 39 . 025) is hereby amended by the addition of the following subsection:
