Notwithstanding any provision of Section 39 . 025 or any <br /> provision of Everett's Zoning Code, the provisions of <br /> this subsection shall exclusively control zoning <br /> locational requirements related to adult bookstores, <br /> adult retail stores and adult video stores. <br /> A. DEFINITIONS. <br /> 1. "Adult use business" as defined in Everett' s <br /> Zoning Code does not include adult bookstores, <br /> adult retail stores and adult video stores as <br /> defined in this ordinance. <br /> 2 . "Adult bookstore" means a retail establishment in <br /> which: Twenty-five percent or more of the "stock <br /> in trade" consists of books, magazines, posters, <br /> pictures, periodicals or other printed material <br /> distinguished or characterized by an emphasis on <br /> matter depicting, describing or relating to <br /> "specified sexual activities" or "specified <br /> anatomical areas" as defined in this ordinance. <br /> 3 . "Adult retail store" means a retail establishment <br /> in which: Twenty-five percent or more of the <br /> "stock in trade" consists of items, including <br /> those items listed as stock in trade in the <br /> definition of adult bookstore and adult video <br /> store, and any other items, products or equipment <br /> distinguished or characterized by an emphasis on <br /> matter depicting, describing or relating to <br /> "specified sexual activities" or "specified <br /> anatomical areas" as defined in this ordinance. <br /> Adult retail store includes retail establishments <br /> which contain stock in trade as defined in adult <br /> bookstore, adult retail store and/or adult video <br /> store where the stock in trade is cumulatively <br /> twenty-five percent or more of the stock in trade <br /> of the establishment. <br /> 4 . "Adult video store" means a retail establishment <br /> in which: Twenty-five percent or more of the <br /> "stock in trade" consists of videos or other forms <br /> of visual media distinguished or characterized by <br /> an emphasis on matter depicting, describing or <br /> relating to "specified sexual activities" or <br /> "specified anatomical areas" as defined in this <br /> ordinance. <br /> 2 <br />
