1. Residential Building. Expansion of a nonconforming residential <br /> building may be allowed using Review Process IV for variances, <br /> provided that the evaluation criteria required for approval of <br /> variances, described in Section 41 of this Ordinance, are <br /> satisfied. Expansion of a single family dwelling which is <br /> nonconforming in setback may be approved by the Planning Director <br /> using Review Process II.B provided that the expansion does not <br /> make the setback more nonconforming, and that the expansion <br /> complies with all other requirements of this Ordinance. <br /> Non-residential Buildings. Expansion of a nonconforming <br /> non-residential building shall be reviewed using Review Process <br /> III.B. The evaluation criteria which shall be considered during <br /> the review of the proposed expansion are contained in Section <br /> 38.090.A. <br /> SECTION 43. Section 38.070 of Ordinance No. 1671-89 is amended by <br /> the addition of the following: <br /> C. Parking lot landscaping. Existing unpaved parking lots <br /> which are paved shall provide the landscaping required by <br /> Section 35.080 of this Title, provided that the Planning <br /> Director shall have the discretion to determine how to apply <br /> the code if the required landscaping will reduce parking <br /> below the minimum required by the code. <br /> SECTION 44: Section 38.080.A. 2 of Ordinance No. 1671-89, which <br /> reads: <br /> 2 . If two or more substandard lots or a combination of lots or <br /> substandard lots and portion(s) of lots or substandard lots <br /> are contiguous and were acquired by common conveyance prior <br /> to the above dates, and if all or part of the lots do not <br /> meet the requirements established for minimum lot area and <br /> width, the lands involved shall be merged and considered to <br /> be a single undivided parcel. No portion of said parcel <br /> shall be used, altered or sold in a manner which diminishes <br /> compliance with lot area and width requirements, nor shall <br /> any division of any such parcel be made which creates a lot <br /> with a width or area below the requirements permitted by <br /> this Ordinance. <br /> is hereby amended to read: <br /> 2. If two or more substandard lots or a combination of lots or <br /> substandard lots and portion(s) of lots and substandard lots <br /> are contiguous and were acquired by common conveyance prior <br /> to the above dates, or which have been legally combined at <br /> any time subsequent to the above dates, and if all or part <br /> of the lots do not meet the requirements established for <br /> minimum lot area and width, the lands involved shall be <br /> merged and considered to be a single undivided parcel . No <br /> portion of said parcel shall be used, altered or sold in a <br /> manner which diminishes compliance with lot area and width <br /> requirements, nor shall any division of any such parcel be <br /> made which creates a lot with a width or area below the <br /> requirements permitted by this Ordinance, except as provided <br /> by Section 38.080.A.4. <br />
