THENCE, North 00-16-40 West a <br /> distance of 368 feet; THENCE, South 37-35-37 East to <br /> intersect a line parallel to and 200 feet Northwest of <br /> said Westerly right of way of Holly Drive; THENCE, North <br /> 45-05-00 East along said parallel line a distance of <br /> 259.83 feet; THENCE, South 44-55-00 East a distance of <br /> 200 feet to intersect the Westerly right of way line of <br /> Holly Drive; THENCE, South 45-05-00 West along said right <br /> of way line a distance of 510 feet to the TRUE POINT OF <br /> BEGINNING. <br /> Section 2: <br /> That upon annexation of the property described in Section 1, said property <br /> shall become a part of the City of Everett, and shall be subject to all of <br /> its laws and ordinances then and thereafter in force. Upon annexation of <br /> the above-described property, all of said property shall be assessed and <br /> taxed at the same rate on the same basis as other property located within <br /> the City is assessed and taxed, to pay for any then outstanding <br /> indebtedness of the City contracted prior to or existing at the date of <br /> this annexation. In addition, the annexed area will remain responsible <br /> unto any other lawfully formed municipal corporation to which the property <br /> is obligated at the time of annexation subject to a specific lien. <br /> Further, the City may incur additional operating expenses in supplying <br /> water or sewage unto persons who are located within the annexed area. <br /> Accordingly, utility rates for the area for which annexation is petitioned <br /> may vary from those rates of other areas within the City. <br /> Section 3: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of <br /> this ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect <br /> the validity of the remaining portions of this ordinance or its <br /> application to any other person or situation. The City Council of the <br /> City of Everett hereby declares that it would have adopted this ordinance <br /> and each section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or more sections, subsections, <br /> sentences, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br /> -2- <br />
