'b. The Planning Director may, using Review Process II .C, <br /> allow alteration or relocation of Category II or <br /> Category III streams only when the applicant can <br /> demonstrate that the alteration or relocation enhances <br /> the functional values of the stream.— <br /> c. Culverting within a stream shall only be permitted as <br /> provided by Section 5 of this Ordinance or to provide <br /> access to a lot or a substantial portion of a lot when <br /> no other feasible means of access exists. Use of <br /> common access points shall be required for abutting <br /> lots which have no other feasible means of access. <br /> Culverting shall be limited to the minimum number of <br /> stream crossings required to permit reasonable access. <br /> The type of culvert used shall be as required by the <br /> Department of Fisheries or Department of Wildlife. <br /> 3. Category IV Streams - Category IV streams may be altered, <br /> relocated or culverted when: <br /> a. the loss of the functional values of the altered stream <br /> can be fully replaced; and <br /> b. no feasible and reasonable development alternative <br /> exists which does not alter, relocate or culvert the <br /> stream; or <br /> c. it is necessary for access to the lot or a substantial <br /> portion of a lot. <br /> 4. Watershed Management Plans - The City shall not allow <br /> relocation or alteration of any Category I, II or III stream <br /> located within an area where an adopted Watershed Management <br /> Plan does not allow for stream alteration or relocation, <br /> except when allowed by Section 5 of this Ordinance, or to <br /> allow access to a lot or substantial portion of a lot when <br /> no other feasible means of access exists. <br /> C. Compensating for Stream Impacts, Stream system and buffer <br /> alteration, when allowed by Section 15 of this Ordinance shall be <br /> subject to the following requirements: <br /> 1. Each activity/use shall be designed so as to minimize <br /> overall stream system or buffer alteration to the greatest <br /> extent possible; <br /> 2 . Construction techniques and field marking of areas to be <br /> disturbed shall be approved by the City prior to site <br /> disturbance to ensure minimal encroachment; <br /> 3 . A mitigation plan shall be prepared in accordance with <br /> Paragraph D of Section 15 of this Ordinance. <br /> 4. The City may require the applicant to rehabilitate a stream <br /> system and its buffer area by removing harmful debris, <br /> sediment, non-native vegetation, or other material <br /> detrimental to the area, by replanting disturbed vegetation, <br /> by removing culverted portions of a stream from culverts, or <br /> by other means deemed appropriate by the City. <br /> 24 <br />
