• <br /> • <br /> accordance with the mitigation plan and that restoration or <br /> rehabilitation is performed in accordance with the <br /> contingency plan if mitigation failure results within five <br /> years of implementation. <br /> E. Protective Covenants and Tracts. The City may require that <br /> streams and their buffers on development sites be placed within <br /> an environmentally sensitive area protective covenant or <br /> environmentally sensitive area tract as provided by Section 20 of <br /> this Ordinance. <br /> F. Fencing and Other Protection Mechanisms. The City may require <br /> that any development proposed on a lot which contains or adjoins <br /> a stream provide a fence or other structural protection along the <br /> upland side of the stream and its buffer to minimize encroachment <br /> into and disturbance of the stream and buffer area. <br /> Section 16: Areas of Special Flood Hazard. Areas of special flood <br /> hazard shall be governed by the provisions of Section 30 of the <br /> Everett Municipal Code. <br /> Section 17: Fish and Wildlife Conservation Areas. It is the goal <br /> of the City to preserve, protect and enhance fish and wildlife <br /> conservation areas through sound habitat management practices. If a <br /> development is proposed on or within a distance which could impact <br /> fish and wildlife conservation areas, as described in this Section, <br /> the applicant shall provide a—Habitat Management Plan (HMP) , <br /> prepared by a qualified expert for evaluation by the City, state and <br /> federal agencies. The HMP shall be based upon sound habitat <br /> management practices and be designed to achieve specific habitat <br /> objectives. The City shall ask the appropriate resource agencies to <br /> review and comment on the development impacts and the provisions of <br /> the HMP. <br /> A. Habitats of Primary Association. When a development is proposed <br /> on or adjacent to a habitat of primary association, the applicant <br /> shall prepare a HMP. All actions shall be taken which are <br /> necessary to avoid reducing the likelihood that the species will <br /> maintain and reproduce over the long term. <br /> B. Riparian Corridors. When riparian corridors are in satisfactory <br /> condition for fish and wildlife use, the habitat management <br /> approach shall be to allow the natural ecosystems to function <br /> with minimal disruption. Protection from human disturbance shall <br /> be carried out by following the standards of this Ordinance for <br /> wetlands, streams, lakes and ponds. When a development is <br /> proposed on a lot with a disturbed riparian corridor, the City <br /> may require that the habitat be enhanced by creating more <br /> diversity and eliminating any source of degradation, including, <br /> but not limited to: <br /> 1 . vegetative plantings of native or preferred wildlife food <br /> species; <br /> 2 . construction of nesting islands or installation of nesting <br /> boxes; <br /> Z7 <br />
