• <br /> G. Providing City officials with sufficient information, <br /> direction and authority to protect environmentally sensitive <br /> areas when evaluating public or private development <br /> proposals; and <br /> H. Implementing the policies of the Growth Management Act, <br /> State Environmental Policy Act, Section 43 . 21C of the <br /> R.C.W. , Section 20.04 of the Everett Municipal Code, the <br /> City of Everett General Plan, and all updates and <br /> amendments, functional plans and other land use policies <br /> formally adopted or accepted by the City. <br /> Section 3: Applicability.-- <br /> A. This Ordinance establishes regulations for the protection of <br /> environmentally sensitive areas. No development permit may be <br /> issued, no subdivision of land may be approved, nor may any use <br /> be established on any lot which contains, adjoins, or is in close <br /> proximity to an environmentally sensitive area until approvals <br /> required by this Ordinance have been granted by the City. Lots <br /> which are listed, identified, classified, or rated as <br /> environmentally sensitive areas are those which are or may become <br /> so designated by the Everett General Plan, Everett SEPA Resource <br /> Inventory Maps, Everett Inventory of Environmentally Sensitive <br /> Areas or by any other studies which indicate that all or portions <br /> of a lot are environmentally sensitive areas. A site specific <br /> analysis which indicates that any environmentally sensitive area <br /> regulated by this Ordinance —exists on a lot will result in that <br /> portion of the lot being classified as environmentally sensitive. <br /> B. In addition to the requirements of this Ordinance, the applicant <br /> shall obtain all necessary State and Federal and other local <br /> permits. <br /> Section 4: Environmentally Sensitive Features. On all lots <br /> containing or adjoining environmentally sensitive areas the <br /> following features shall not be altered or developed except as <br /> otherwise permitted by this Ordinance. <br /> A. Area of flood hazard (if located in a designated floodplain, <br /> see Section 19. 30 of the Everett Municipal Code) ; <br /> B. Wetlands; <br /> C. Streams; <br /> D. The following geologically hazardous areas: <br /> 1 . Slopes of 40% or greater <br /> 2 . Erosion hazard areas when associated with another <br /> environmentally sensitive areas; <br /> 3 . Landslide hazard areas; <br /> 4 . Seismic hazard areas; <br /> 3 <br />
